Starting a(n) Construction Business Licenses & Tax IDs
Hi, I'm   bozeman mt   I have a construction business building new homes in the bozeman montana area. I do light framing, roofing, painting, siding.I am a simple craft vendor. I am an amueter artist and sell paintings. all i do is craft show. do i need a vendor license?

 Starting a llc for a construction company.  Need to set up an llc for a construction company namely  A & G construction Partners in Saint peters St. Charles County, MO.
A: You can set up a free llc here  online.  All llcs in MO need an LLC certificate, and an operating llc agreement. In addition, you will need to obtaina federal tax id and a business license.  If you sell any merchandise under the llc, you will need a seller's permit and hiring employees requires a state ein. 

In addition to a contractor's state license that requires that you take an exam, if applicable in your case, the majority of Construction businesses, 99.9%, you will need an occupational business license even if you obtain a free LLC filing or you incorporate.
You will be subjected to an exam to get a business license if you do any major stuctural work as in adding a big room to a house. In addition, you may need a federal tax ID number, and if you sell any merchandise, you will need a resale tax ID number. Also note that all LLCs need an occupational Construction business license. Also, if the llc has more than one member, or you will file a tax return for the LLC as a corporation as opposed as a disregarded entity, you will need a federal tax ID number for the LLC.Starting a business fist step is to choose the tax legal structure. There are three major ones:
1. Sole proprietor, Needs to file at least a dba and get a federal tax id. For example, if the construction company name is "A and Jays Construction," it is a trade name. If you file and llc with that name, you don't need to file a dba.
2. Partnership, Needs to file at least a dba and get a federal tax id, and
3. Corporation or Construction Limited Liability Company. All small, home or web based businesses as well as big businesses must choose and register as on of the above.
In addition, Construction businesses must obtain a business tax registration occupational license receipt.
If selling any taxable items, such as bath sinks etc, a business must also get a reseller ID number to buy wholesale and sell retail.
Finally, if a Construction business is an employer, it needs to get a federal EIN and a State EIN.I have a construction business building new homes in the bozeman montana area. I really dont make much money doing it. kinda a hobby i buy all goods retail. sell to cover materials. do i still need a license? none of this applies. I don't sell wholesale i don't make much if any profit. I pretty much sell what i paint to make room for me to paint more stuff. all a hobby.

   



1. SELECT LLC, DBA, CORP

From sole propr., San Jose LLC, CA partneship or CA Corp.: Each requires an entity certificate filing.



2. TAX IDs - PERMITS

All Internet Business   businesses/entities need a business license and an EIN.



3. San Jose STATE SALES TAX ID.

Selling/Buying wholesale or retail requires a San Jose   seller's permit.


You can choose to be a(n) :

  • Sole Proprietor,
  • LLC,
  • Corporation or
  • Partnership.
    After you decide and select your business entity, you need licensing.



Acampo Business Tax Registration ( Business License)
All businesses including home, online or mobile BUSINESS need a BUSINESS license because they are BUSINESSES.



A(n) business using a DBA Doing Business As Trade Name in San Joaquin County , i.e., starting businesses using a company name other than the legal (given name) owner's name, need a(n) DBA Doing Business As Trade Name Registration.   For example, you start a(n) business and you call it "Ultra Co". You will need to file a trade firm name for it.

Also, keep in mind that in San Jose though, a business license and a DBA is necessary for most businesses but if your business sells any taxable items, you will need a sales tax ID number.  (A.K.A state id, wholesale, resale, reseller certificate, about $39 for most states).

Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.
However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting a federal tax ID number.


If you are thinking of hiring help, you will need a state employer ID and an IRS number employer ID. I.e., a San Jose Federal Tax Id Number ($29)  and a(n) San Jose  State Employer Tax Number  


Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Acampo, Incorporate in San Jose  or form a(n) San Jose LLC


If you will set up a corporation or form an LLC, you will not have to file a DBA (Doing Business As) unless your corproration or LLC name will be different that the busienss name you will trade under. Businesses that use the full legal name of the owner as a business name do not need to register an assumed business name. So, for example, your name is "John X Doe" and you use that as a business name.
 



If you do form an   llc or incorporate (about $49 plus state fees for most states) your business instead of just filing a fictitious business name (dba), it will help you avoid legal and financial personal liability arising out of business transactions and you will not have to register the Acampo business name. Instead of filing a San Joaquin County fictitious business name (our service fee includes dba business name filing and legal paper publication) you can elect to incorporate in San Jose or form an San Jose LLC (starts @ $49 plus state fee for most states & includes bylaws and LLC operating agreement)..
